General terms for local accompaniment and guided visits in Togo<\/h2>\n

TogoSunny O\u00dc \u00b7 Version dated 18 October 2026 \u00b7 English<\/em><\/p>\n

These terms cover only the visit programme preparation, local accompaniment and guided visits sold by TogoSunny. The quote and the \u201cProgramme Guided Tour\u201d PDF specify the agreed services. You organise your journey and independently choose, book and pay directly for all other services.<\/p>\n

1 Service provider and contacts<\/h3>\n

The contracting seller is TogoSunny O\u00dc, registration number 17141420, Kopli tn 82, Harju maakond, Tallinn, 10412, Estonia. Bookings, cancellations and complaints: klientservices@togosunny.com<\/a>; +372 5191 6708. Personal data: info@togosunny.com<\/a>.<\/p>\n

Before booking, the quote or programme identifies the operational contact in Togo, their role, contact details, contact hours and the procedure for difficulties or emergencies during the services. Guides working for TogoSunny are identified, or their role and the arrangements for confirming their identity are stated. These contacts do not constitute a continuously available emergency service.<\/p>\n

2 Services sold and applicable rights<\/h3>\n

TogoSunny sells only preparation of the agreed visits, local accompaniment and guided visits during the days, time slots and attendance periods stated in the accepted quote. TogoSunny\u2019s fees and the fees of the guides specified in the quote are included. Tickets, admission charges and third-party services are not included.<\/p>\n

You independently choose, book and pay other suppliers directly. TogoSunny does not sell or book these services on your behalf, add them to a combined shopping basket, collect their price or make bookings in your name. TogoSunny does not organise a linked booking process, transfer your details to make external bookings or arrange a combined payment. Any practical information provided does not constitute a booking or an authority to purchase on your behalf.<\/p>\n

These rules describe the chosen contractual operation. A commercial title or direct payment of other suppliers does not, by itself, determine the legal classification of the activity. Mandatory rights remain unaffected. If the actual operation falls within package travel or linked travel arrangement rules, the corresponding obligations apply, including required pre-contract information, liability, assistance and insolvency protection. Information on the seller\u2019s capacity and any legally required registrations and protection is then supplied before the traveller commits.<\/p>\n

3 Quotes and booking<\/h3>\n

Every booking requires a written quote, including bookings for five travellers. Groups consist of 5 to 12 people. A personalised quote is required for more than five travellers; a starting price calculated for five does not automatically apply to a different group composition.<\/p>\n

Before acceptance and any payment to TogoSunny, you receive the quote, these terms, the \u201cProgramme Guided Tour\u201d PDF and applicable regulatory information by email or another durable medium. They specify the offer, dates including the year, participants, exact number of visits, selected places, known access conditions, accompanied days and time slots, guide attendance periods, language, meeting arrangements and accepted special requests. They also state the total price including applicable taxes, exclusions, payment dates and methods, and the rules for changes and cancellation.<\/p>\n

The intended period is between February and April. This is not a guaranteed availability calendar or an offer automatically available every year. Dates and guide availability are confirmed before booking. Accompaniment is offered mainly in English and French. Basic Estonian may be used for simple exchanges; full guided commentary in Estonian is not promised. The contractual language of the visits is stated in the quote.<\/p>\n

Places are selected after contact with TogoSunny by email or a scheduled video consultation. Booking requires your written acceptance and TogoSunny\u2019s written confirmation, subject to the initial payment arrangements stated in the quote. Submitting a form alone does not confirm a place or availability. Before and after booking, you can communicate with a TogoSunny representative by email or through scheduled video consultations to prepare your visits and ask questions.<\/p>\n

4 Prices and payment<\/h3>\n

Starting prices per person, based on five travellers, are \u20ac1,000 for Sunny Togo Getaway, \u20ac1,500 for Experience Togo and \u20ac2,000 for Grand Tour of Togo. They cover only TogoSunny\u2019s services described in Article 2. Your other travel expenses are additional. The contractual price is the accepted quote price, stating both the group total and the amount per person.<\/p>\n

The final price depends in particular on dates, group size, accompanied days and hours, language and programme. Amounts payable to TogoSunny, applicable taxes, any initial payment, balance, payment dates and accepted payment methods are disclosed before acceptance. No deposit percentage or payment deadline missing from the quote is presumed to apply. These terms do not provide for unilateral increases to the accepted price or imposed additional services.<\/p>\n

An initial payment counts towards the total price; it is not automatically forfeited on cancellation. Late payment first triggers a written reminder stating the amount due, a reasonable time to remedy the delay and the possible consequences. Any suspension or termination must comply with the contract and law; any retained amount remains subject to Articles 8 and 9. Payment disputes and refunds are handled with TogoSunny without requiring you to wait for a guide or another provider to reimburse TogoSunny.<\/p>\n

5 Programme and visits<\/h3>\n

Places shown on the website are suggestions. Only places and services included in the accepted programme form TogoSunny\u2019s commitment, subject to the adjustments in Article 7. Sunny Togo Getaway includes no more than ten guided visits; the exact number is confirmed before booking. This cap does not automatically define the content of the other two offers, which is specified in their own quote and programme.<\/p>\n

A 12-day or 15-day programme describes the period over which visits are spread. It does not mean continuous, daily or 24-hour guide attendance. Accompaniment may be scheduled from your arrival day to your departure day, only during the agreed days, time slots and attendance periods. Attendance on arrival or departure applies only if expressly agreed; it does not include an airport transfer. The programme distinguishes accompanied visits from free time.<\/p>\n

Opening hours, authorised access and required permissions are checked for selected visits. Known admission charges, currency, amount or calculation method and direct payment arrangements are supplied for information before acceptance. Any external expense that is unknown or may change is identified as such and is not represented as included in the price. TogoSunny does not book or collect payment for workshops, cooking classes, crossings or other paid third-party services. Additional accompaniment by TogoSunny, including evening outings, requires written agreement on its scope and price.<\/p>\n

6 Accommodation meals transport and other external services<\/h3>\n

You independently organise your accommodation, including any villa or hotel, all meals and drinks, all transport and airport transfers. Vehicles with a driver, taxis, motorbike taxis, fuel, tolls, crossings, rentals and parking are not included in TogoSunny\u2019s price. TogoSunny does not sell or guarantee any vehicle capacity, overnight accommodation, room, dinner or transfer in these offers.<\/p>\n

Flights, visas, formalities, insurance, tickets and admission charges, workshops, cooking classes, paid activities, purchases, tips and personal expenses are also your responsibility. You choose suppliers, contract with them directly, check their terms and pay them directly, without TogoSunny arranging their booking or collecting their price.<\/p>\n

Information on journeys and foreseeable costs helps prepare meeting arrangements and visits; it does not create a package including those services. Changes and refunds for your external contracts must be handled directly with their suppliers. This separation does not remove TogoSunny\u2019s liability for its own fault or the traveller\u2019s mandatory rights.<\/p>\n

7 Changes and practical arrangements<\/h3>\n

An updated programme may clarify contacts and meeting arrangements before arrival. Essential characteristics of the accompaniment must already have been supplied before your acceptance and payment. An update cannot introduce a reduction of services or an additional charge without your agreement.<\/p>\n

Visit order and timings may be adjusted for opening hours, journey times, weather, authorised access, guide availability and safety. Minor adjustments preserve the agreed content and quality. A substantial change, replacement service or price impact is explained on a durable medium and requires your written agreement. Refusal does not remove your rights to an appropriate solution, a price reduction or termination and a refund under the contract and law.<\/p>\n

Immediate safety measures may be taken without delay, with information as soon as possible; applicable rights remain unaffected. Cultural visits respect residents, local practices and site instructions. Outdoor activities are adapted if they cannot reasonably take place safely. Changes you request, including a change in participant numbers, are addressed in a written proposal and do not automatically increase the price payable by other participants.<\/p>\n

8 Cancellation by the traveller<\/h3>\n

Send cancellation to klientservices@togosunny.com<\/a>, identifying the quote reference and affected participants. It takes effect when your notice is received, regardless of internal processing time. A partial cancellation is accounted for against the affected services. Any change in price or arrangements for remaining participants requires their written agreement.<\/p>\n

Before services begin, TogoSunny retains only evidenced expenses related to your contract that have actually been incurred or are irrevocably payable and remain unavoidable despite reasonable efforts to reduce them. Savings, recovered amounts, refunds and actual opportunities to reallocate the services are deducted once. There is no fixed cancellation scale, automatically earned percentage or automatic forfeiture of the initial payment.<\/p>\n

After services begin, the value of services properly performed may be payable in addition to admissible cancellation costs for the remaining services, without double charging. Preparation already performed may be charged separately only if it is a genuine service with a disclosed and accepted value; it cannot be used to make the entire price artificially non-refundable. The total does not exceed the contractual price of the affected services, subject to more favourable mandatory rights, including withdrawal rights.<\/p>\n

An itemised statement is supplied. Excess payments are refunded under Article 9; a further payment is claimed only if contractually and legally justified. No-show, lateness, visa refusal or personal interruption does not automatically result in a 100% charge. TogoSunny does not charge cancellation fees for a flight, hotel, transport or other external service that it has not sold, booked or collected payment for. Your external contracts remain subject to their own terms.<\/p>\n

9 Cancellation by TogoSunny and refunds<\/h3>\n

If TogoSunny cancels before accompaniment begins, payments for the cancelled services are refunded in full. If only part cannot be performed after services begin, the amount for the unprovided services is refunded, without prejudice to other applicable rights. A distinct service already properly performed cannot be separated artificially to circumvent those rights.<\/p>\n

Postponement, credit or a replacement service requires your agreement and cannot automatically replace a refund due. Compensation rights for non-performance attributable to TogoSunny remain unaffected. If mandatory travel rules apply, their cancellation rights, including for unavoidable and extraordinary circumstances meeting the legal criteria, and their refund and assistance rules prevail. External circumstances do not automatically make every payment non-refundable.<\/p>\n

Refunds due under Articles 7 to 9 are made without undue delay and no later than 14 days after cancellation or termination of the affected services. They use the original payment method unless you expressly agree to another method at no cost to you. This deadline does not depend on reimbursement from a guide or partner. Withdrawal refunds follow Article 10. Goods-return rules and the general 24-hour deadline shown for certain other services on the website do not replace these specific rules.<\/p>\n

10 Withdrawal and services on specified dates<\/h3>\n

The statutory 14-day withdrawal right applicable to certain distance contracts is distinct from contractual cancellation. Leisure visits scheduled for a specific date or period fall within the legal exception when its conditions are met. The absence of this right is then disclosed before you commit; the cancellation options in Articles 8 and 9 and remedies for defective performance remain available.<\/p>\n

If a service sold is instead subject to a withdrawal right, including a distinct service not covered by that exception, you receive the appropriate information and form before committing. The statutory period normally runs from conclusion of the service contract. You may notify an unambiguous decision to klientservices@togosunny.com<\/a>; use of the form is optional. Repayments due are made within 14 days of notification, subject only to deductions permitted by law.<\/p>\n

Starting performance during that period requires your express request where the law requires it. A proportionate amount for a service already supplied is payable only if legal requirements for information and a prior request have been met. Loss of the right following full performance of a paid service requires prior express consent and acknowledgement of that loss where required. These rules never remove remedies for defective services. The 14-day statutory goods return period and a commercial 30-day goods return period are not accompaniment cancellation periods.<\/p>\n

11 Participation formalities and insurance<\/h3>\n

You organise your flights and check requirements with the competent authorities for your nationality and situation: passport, visa, entry and transit, health and other formalities. You submit applications and pay the fees directly. TogoSunny may supply general practical information and direct you to official sources; it does not guarantee a visa or entry. Accommodation information must correspond to your actual bookings. Late arrival or early departure is addressed according to the services actually affected and Articles 7 to 10.<\/p>\n

Before booking, disclose accessibility needs, participation constraints and special requests relevant to the visits. Their acceptance requires written confirmation; universal accessibility is not presumed. Only necessary information is requested, not a complete medical history. Any sensitive information is handled under Article 13. Minors remain the responsibility of their accompanying adult.<\/p>\n

You follow reasonable instructions from guides and sites. A reasoned safety measure must remain proportionate and does not automatically justify retaining the entire price. Travel insurance, including medical care, assistance, repatriation and cancellation cover according to your needs, is independently arranged and paid for by you and is not included in the offer. Such insurance does not replace TogoSunny\u2019s obligations.<\/p>\n

12 Difficulties liability and complaints<\/h3>\n

Report difficulties promptly to the guide or TogoSunny during the services to allow correction where possible. This does not remove your statutory rights. TogoSunny remains responsible for the accompaniment and visits it sells, including where performed by a guide or subcontractor.<\/p>\n

Depending on the situation and applicable law, you may seek correction, an appropriate alternative service, a price reduction, a refund, termination or compensation. No clause excludes liability that cannot legally be excluded. Separate sale of other services is not a general exclusion of liability for TogoSunny\u2019s own commitments.<\/p>\n

Send a written complaint to klientservices@togosunny.com<\/a> with your contact details, quote reference, facts, relevant evidence and requested solution. TogoSunny replies in writing within 15 days. If unresolved, you may apply to the Estonian Consumer Disputes Committee where it has jurisdiction, consult the relevant European Consumer Centre for a cross-border dispute or apply to a competent court. Information: https:\/\/ttja.ee\/en\/consumer-disputes-committee<\/a>. Mandatory consumer rules on jurisdiction remain applicable.<\/p>\n

13 Personal data and applicable documents<\/h3>\n

TogoSunny O\u00dc is the controller of data needed for quote requests, visit preparation and performance, contacts, invoicing and complaints. Legal bases are requested pre-contractual steps and the contract, legal obligations for accounting records and, where relevant, proportionate legitimate interests in handling complaints and defending rights. The Privacy Policy<\/a> provides further information.<\/p>\n

Only necessary data are accessible to authorised persons and, when necessary, the guides performing the services. Before disclosure to a separate recipient in Togo or another country outside the European Economic Area, TogoSunny identifies the recipient, role, data, purpose and applicable transfer mechanism and supplies the required information. A transfer relies on an applicable adequacy decision or appropriate safeguards; a legal derogation may be used only where its specific conditions are met. Accepting these terms is not blanket consent to transfers. Data are not sent to hotels, transport providers or other suppliers to make your external bookings.<\/p>\n

Health information is collected only where necessary for a specific request and with an appropriate legal basis, including explicit consent where required. Marketing and promotional use of your image involve separate optional choices. Refusing these uses is not a condition of booking. Data are retained as needed for their purposes and applicable claim periods; accounting records are retained for the statutory period, generally seven years from the end of the relevant financial year. Sensitive data are deleted when no longer needed unless a legal obligation justifies retention.<\/p>\n

You may exercise access, rectification, erasure, restriction, portability and objection rights where their conditions are met, and withdraw consent for the future, by writing to info@togosunny.com<\/a>. You may complain to the competent supervisory authority, including Estonia\u2019s Andmekaitse Inspektsioon. A refund request does not cause immediate deletion of all records that must legally be retained.<\/p>\n

The contract consists of the accepted quote, the \u201cProgramme Guided Tour\u201d PDF, these terms and mandatory information supplied before commitment. The Terms of Sale<\/a>, Privacy Policy<\/a> and Return and Refund Policy<\/a> complement these documents. For local accompaniment and guided visits, these specific rules and the accepted quote prevail over incompatible general rules for goods or other services, without reducing mandatory rights or expressly accepted more favourable commitments. Any inconsistency identified before booking is clarified in writing. Estonian law applies without depriving consumers of applicable mandatory protection under the law of their habitual residence. The French and English versions express the same commitment; translation cannot reduce the traveller\u2019s rights.<\/p>\n

Annex 1 Sunny Togo Getaway<\/h3>\n

A 12-day programme in Lom\u00e9 and the surrounding area, from \u20ac1,000 per person based on five travellers; groups of 5 to 12. Any reference to \u201c12 days and 11 nights\u201d describes your travel period: the eleven nights are not accommodation sold by TogoSunny. The intended period is between February and April, subject to written dates and availability.<\/p>\n

Up to ten guided visits may be selected. Suggestions include Lom\u00e9 Palace, the Independence Monument and city centre, Sacred Heart Cathedral, the Grand Market, Akod\u00e9ss\u00e9wa Fetish Market subject to access and respect for local practices, the craft village or local crafts, the fishing port and seafront subject to authorised access, and Agbodrafo, Togoville or An\u00e9ho, possibly including the Slave House or Lake Togo. Actual visits and their time slots are selected after contact with TogoSunny and confirmed before booking.<\/p>\n

Workshops, cooking classes, crossings and other third-party activities remain external choices that you book and pay for directly. No eleven-night villa stay, dinner, vehicle, airport transfer, fuel, toll or motorbike taxi is included. Any guide attendance on arrival and departure and its hours must be stated in writing; it does not include transport or create continuous accompaniment.<\/p>\n

Annex 2 Experience Togo and Grand Tour of Togo<\/h3>\n

Experience Togo is a 15-day programme from \u20ac1,500 per person; Grand Tour of Togo is a 15-day programme from \u20ac2,000 per person. These starting prices are based on five travellers, for groups of 5 to 12. Any reference to fourteen nights does not include accommodation sold by TogoSunny. The former labels Comfort and Discovery Package and Complete and Customizable Package, if still displayed, do not denote accommodation categories or included external services.<\/p>\n

For each offer, the quote separately defines regions, number and locations of visits, days, hours, guide attendance periods, language and meeting arrangements. Suggestions for another offer are not automatically promised. Personalisation remains limited to the visit preparation and accompaniment sold. The intended period is between February and April, with dates, year and availability confirmed in writing. Accommodation, meals, transport, transfers and third-party activities remain excluded and independently booked and paid for by travellers.<\/p>\n

Annex 3 Information to confirm in every quote<\/h3>\n

Before acceptance and payment, the quote and PDF confirm the following for your chosen offer.<\/p>\n
